Description

Responsible for the development and management of complex, multi-year fixed price, time and materials, labor hours and cost-type agreements (subcontracts) requiring ongoing oversight and administration of statements of work, terms and conditions, correspondence, change management, and subcontract compliance. Collaborates closely with Program and Project Management, Engineering, Operations, Project Controls (Cost and Schedule), Accounts PayableFinance, and Quality. This position is located at the Project Site.

·         Negotiates subcontract pricing and provisions, prepares/issues subcontracts, identifies and manages supplier risks and administers resulting subcontracts.

·         Oversees the management of subcontractors to ensure fulfillment of contractual obligations. Negotiates changes to purchase agreement terms and pricing Responsible for managing the formation and issuance of solicitations, evaluation of proposals, negotiation and award of procurements and the closeout of procurements from cradle to grave.   Ensures value-based selections are made when proposals are received.

·         Responsible for implementation of subcontract management tools, i.e. Subcontract Status Report, Project Subcontracting Strategy

·         Coordinate subcontract Post Award Meetings and Pre- Construction Kickoff Meetings.

·         Prepares and controls (manages) subcontract correspondence to suppliers and contractors.

·         Identifies targets and objectives for negotiated changes to terms and conditions of all subcontracts, which improves company profitability and risk. Oversees and participates in high value subcontract negotiations.

·         Assists in the negotiation of proposals based on obtaining adequate subcontract terms and prices to maximize revenue and fees earned.

·         Advises Project Managers (PM’s) and Requestors on compliance matters and recommends actions necessary to avoid unnecessary risk subcontract issues.

·         Communicates proposed bilateral and unilateral contractual changes to Finance and Project controls groups to determine the profitability impact of the changes.

·         Helps draft/negotiate Teaming Agreements, Non-Disclosure Agreements, Memorandums of Understanding (MOU’s), and other agreements as part of obtaining procurement support for new business opportunities.

·         Successfully works across organizational boundaries to deliver business goals and objectives.

·         Consults with internal Clients (PM’s, Requestor’s, Business Development, subsidiary PM’s, etc.) on subcontracts and related issues.Maintain ongoing contractual lessons learned and share with other projects.

·         Frequently interfaces with Subcontractors or Suppliers, Quality Assurance (QA) , External Auditors, Internal Program/Project Managers, Legal,Project Controls (Cost and Schedule)  Accounting, Finance, HR and others.

·         Develops and maintains strong business relationships with the subcontractors’ designated representative.

·         Manages administrative tasks including the coordination and support of milestone payments, schedule of values based payments, performance based payment, invoice review, and ongoing communication with the subcontractors and program teams.

·         Develops solutions in resolving supplier contractual issues that requires a high level of understanding of contract terms and conditions.

·         Performs other duties as assigned.

Job Requirements

·         Ability to develop and negotiate teaming agreements, master subcontract agreements, and blanket purchasing agreements

·         Proven ability to build and maintain solid relationships based on mutual respect with senior level internal and external customers, peers and team members

·         Demonstrated ability to influence key decision-makers and to effectively negotiate with Subcontractors

·         Ability to simultaneously manage multiple subcontracts and priorities

·         Strong problem solving and critical thinking skills, ability to exercise independent judgment and manage complexity and ambiguity. Strong negotiation and interpersonal skills and demonstrated project management skills.

·         Strong written and verbal communication skills, strong presentation skills, and the ability to listen well and communicate effectively with others

·         Proven ability to collaborate across the organization and operate effectively within a matrix environment by resolving conflict and influencing others

·         Proven track record that includes collaborating with Program/Project Management and Engineering/Technical individuals regarding management of contractual requirements.

·         Ability to draft complex subcontracts for virtually all requirements

·         Detailed knowledge of EPC, construction, and construction management contractual concepts. Ability to research legal issues with minimal assistance.

·         Demonstrates leadership capabilities through problem solving and customer service.

·         Demonstrates skills and continual improvement in the subcontracting discipline.

·         Demonstrates skills and is viewed across the organization as an expert in the contracts and subcontracts discipline

·         Ability to read understand basic engineering documents

·         Willingness and ability to effectively mentor and train junior personnel within the group.

·         Ability to sit

·         Ability to effectively communicate; speaking, reading, understanding, writing and hearing clear English; pass audiogram in hearing conservation program as required by location

·         Basic math and computer skills

·         Ability to work inside at the project site

·         Ability to perform highly repetitive motions with fingers, hands, wrists, and shoulders

·         Ability to work alone, work with others, and interact with the public

·         Ability to perform under deadline pressure

Minimum Qualifications and Years of Experience

Education

·         Bachelor's degree required or equivalent experience

 

Certifications

 

Required Experience

·         Minimum of 15 years procurement/subcontract administration experience

·         Minimum of 10 years major subcontract administration experience

·         Experience as lead subcontracts representative based on an active construction project

·         Ability to mentor, train, and develop subcontracts team members

·         Experienced  negotiator.

·         Experience with settlement negotiations and alternate forms of dispute resolution.

·         Experience with performance bonds, parental guarantees, insurance, and letters of credit.

 

Preferred Experience

·         Experience with Oracle Procurement Module
